Such a classless and clueless
Such a classless and clueless action by the lawyer who obviously had their own interests (the law firm) in mind ahead of their clients (Guardian). I am dealing with the same type of law firm in regards to a manufactures defective products. My thumbnail is that the manufactures legal team (of the manufacturer that we had to sue to get them to even respond reasonably) is costing the manufacture 3-5 times as much as it would have if instead the manufacturer had handled the problem directly and civilly. Not to mention a 300-400K in sales it has cost the complicit wholesaler that I once was loyal to. Un-freaking-believable!!!

The phenomenon is called The Streisand Effect. - In summary, the more you try to suppress negative news, the more exposure it gets.

Make Guardian pay your legal fees with no non-disclosure clause in the settlement terms. Then tells us about it.

Today I received a letter from the president and CEO of Guardian apologizing for their actions and promising not to pursue the matter. I'll write more about it in tomorrow's post here in the EV blog.

I'll let Allison provide details, but I received a copy of a letter from Steven Ziessler, the President of Guardian Building Products, that appears to be more conciliatory and circumspect than the original letter from Mr. Metz. I don't think that Allison will have to mortgage his house for legal fees....

My first reading of this was that someone had a son/daughter who recently graduated with a (poor) law degree. The Lanham Act refers to trademark infringement, i.e., someone using someone else's trademark for personal gain. In other words, if you put cotton candy between two sheets of kraft paper and sold it as Guardian Insulation, you might get a nasty cease-and-desist letter. For showing a bad example of batt installation, however, this is just a sad commentary on corporate shallowness.

Not really latin, but you get the idea.
I've been there too with a foil bubble wrap guy that wanted to have his way with me for my telling a homeowner (a year after construction) that the foil bubble wrap under his radiant floor wasn't R-10. One email with substantial research documentation and I no longer heard from him. He was smarter than this guy I guess.
